Terms of Service

These terms apply when you use www.elijahdesent.com or buy website design, hosting, the website editor, website chat, or other services from Elijah Desent (“we,” “us”), a business based in Warren, Michigan. By using the site or our services, you agree to them. If you’re agreeing for a church or other organization, you confirm you’re allowed to do so on its behalf.
Our services
We design and build websites, host them, keep them updated, and provide tools — including an editor that lets you change your site by chatting with ChatGPT, Claude, or another AI assistant. Free concepts and demos are offered with no obligation. The exact price and scope of your project are what we quote you on your invoice or signup page, and if those differ from anything on our marketing pages, your invoice controls.
Payment and billing
- Design or setup fees are billed as stated on your invoice, either up front or in the installments listed there.
- Hosting and updates are billed monthly or yearly through Stripe and renew automatically until you cancel.
- If a payment fails, we’ll let you know and give you a reasonable chance to update it. If it stays unpaid, we may pause hosting until the balance is settled.
- Prices may change for future billing periods; we’ll tell you in advance.
Cancelling and refunds
There’s no long-term contract. You can cancel hosting at any time by emailing me@elijahdesent.com; it stops at the end of the period you’ve already paid for. Payments already made are not refundable, except where the law requires otherwise or we agree in writing. If something isn’t right, please tell us — we would much rather fix it.
Who owns your website
Once your design fee is paid in full, the design and content of your website belong to you. Your text, photos, logos, and other materials always remain yours. If you leave, we’ll hand over your site’s files and help you move your domain. Third-party pieces — fonts, open-source code, stock media, and services like Stripe or YouTube — stay under their own licenses.
We keep the right to reuse our general know-how, code patterns, and tools, and, unless you ask us not to, to show your site in our portfolio.
Your content and responsibilities
- You confirm you have the right to use everything you give us or publish on your site, including photos, music, logos, and text.
- You give us permission to copy, edit, and publish that material as needed to build, host, and support your site.
- You’re responsible for what your site says and what it collects from your visitors, and for complying with the laws that apply to your organization.
- Keep your sign-in, GitHub account, and domain registrar access secure.
The AI website editor
Changes made through the editor are published to your live site, usually within a few minutes. AI assistants can make mistakes, so please review changes before and after you publish them; most changes can be undone. You’re responsible for changes made through your account. Your use of ChatGPT, Claude, or another assistant is also governed by that provider’s own terms.
Acceptable use
You may not use our services or the sites we host to:
- break the law or infringe anyone’s rights;
- send spam, malware, or phishing, or collect people’s information deceptively;
- attack, overload, or try to break into our systems or anyone else’s;
- resell or re-host our services without our written permission.
We may suspend service that violates these rules, and we’ll tell you why.
Grants and promotions
Giveaways such as the Small Church Grant are governed by their own official rules, which control if they conflict with these terms.
Third-party services
Our services rely on providers such as Vercel, GitHub, Stripe, Google, Slack, and AI providers. We’re not responsible for their outages or policies, though we’ll work to restore your site quickly if one of them has a problem.
Disclaimers
We work hard to keep your site fast, secure, and online, but our services are provided “as is” and “as available.” We don’t promise uninterrupted service, error-free operation, or any particular search ranking, traffic, or results. To the extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
Limitation of liability
To the extent the law allows, we aren’t liable for indirect, incidental, special, or consequential damages, or for lost data, revenue, or donations. Our total liability for any claim relating to our services is limited to the amount you paid us in the 12 months before the claim arose.
Ending service
You can stop using our services at any time. We may end or suspend service if these terms are seriously or repeatedly broken, or if an invoice stays unpaid. Either way, we’ll give you a reasonable chance to get a copy of your site’s files.
Governing law
These terms are governed by the laws of the State of Michigan. Any dispute will be handled in the state or federal courts located in Macomb County, Michigan, unless we both agree otherwise. We’d always rather talk it through first.
Changes to these terms
We may update these terms from time to time. We’ll change the date at the top, and if the change is significant we’ll let current clients know before it takes effect. How we handle your information is covered in our Privacy Policy.
